This Privacy Policy explains how APD collects, uses, discloses, retains, and protects personal information in connection with TiksiFlow for United States operations, including the distinction between APD account data and Customer Data processed on a Customer’s behalf.

1. Scope of This Privacy Policy

This Policy applies primarily to personal information for which APD determines the purposes and means of processing, including website visitors, account registration, free trials, subscriptions, billing, payments, customer administration, technical support, security, communications, and commercial relationships.

When a TiksiFlow Customer uploads personal information relating to its own customers, employees, suppliers, prospects, contractors, or other individuals, the Customer generally acts as the applicable controller, business, or responsible party and APD processes that information on the Customer’s behalf as a processor, service provider, contractor, or equivalent role.

2. Personal Information We Collect

Depending on the interaction, APD may collect identification and business contact information; account identifiers, roles, authentication records and preferences; Subscription and commercial information; billing and transaction information; device, network, IP, browser, operating-system, login, security and usage information; and messages, support requests, feedback, and correspondence.

APD does not intend to store complete payment-card numbers or card security codes. Card information is processed by the applicable payment processor.

3. Sensitive Personal Information

APD does not intentionally request sensitive personal information as a requirement to register or administer a standard TiksiFlow account. Customers may choose to process information through TiksiFlow that is considered sensitive under applicable law. When such information is Customer Data, APD processes it on the Customer’s behalf, and Customer is responsible for determining whether it may lawfully submit and process it.

4. How We Use Personal Information

APD may use personal information to create and administer accounts; authenticate Users; provide trials and the Service; administer Subscriptions; process payments and billing; provide support; send account, security and operational communications; manage renewals and cancellations; prevent fraud and unauthorized access; investigate incidents; maintain technical and audit records; improve performance, reliability and security; comply with legal, tax, accounting and governmental requirements; establish or defend claims; and protect APD, Customers, Users and third parties.

APD may use aggregated or de-identified information for analytics, capacity planning, product improvement, security, and legitimate business operations.

5. Marketing Communications

Where permitted by law, APD may send information about TiksiFlow features, services, promotions, training, demonstrations, events, and surveys. Recipients may opt out using the unsubscribe mechanism in the communication or by contacting hola@tiksiflow.com. Transactional, billing, security, and support communications may still be sent when necessary.

6. Cookies and Similar Technologies

TiksiFlow websites and applications may use cookies, local storage, and similar technologies to maintain sessions, protect security, remember preferences, provide functionality, understand performance and usage, and diagnose technical problems. If APD later introduces targeted advertising or tracking that requires additional notice, consent, or opt-out rights, applicable controls and this Policy will be updated.

7. How We Disclose Personal Information

APD may disclose personal information to providers of cloud infrastructure, hosting, storage, backups, payment processing, email, communications, cybersecurity, monitoring, support infrastructure, invoicing, tax, accounting, legal, and advisory services as reasonably necessary to operate TiksiFlow and subject to applicable requirements.

Information may also be disclosed when required by law, valid legal process, fraud or security investigation, protection of rights or safety, a merger or business transaction, or at the direction or consent of the relevant person or Customer.

8. Sale, Targeted Advertising and Profiling

APD does not sell personal information for monetary consideration. APD does not currently process personal information collected under this Policy for targeted advertising based on activity across unaffiliated businesses or services, and does not currently sell or share sensitive personal information for targeted advertising. If these practices change, APD will provide the notices and controls required by applicable law.

9. Customer Data and Service Providers

When APD processes personal information on behalf of a TiksiFlow Customer, APD will process it only as reasonably necessary to provide TiksiFlow, follow the Customer’s lawful instructions, secure and maintain the Service, provide support, prevent abuse, comply with law, and fulfill contractual obligations. APD may use subprocessors subject to appropriate data-protection obligations where required.

10. International Processing

APD is located in Mexico. Personal information may therefore be processed in Mexico and in other countries where APD’s infrastructure or service providers operate. APD will use contractual, technical, organizational, and other safeguards required by applicable law for international processing or transfers.

11. Data Retention

APD retains personal information for as long as reasonably necessary to provide TiksiFlow, maintain business and transaction records, comply with tax and accounting requirements, protect security, prevent fraud, resolve disputes, and comply with legal obligations. Customer Data associated with a suspended account may generally remain available for up to sixty (60) calendar days for reactivation, after which it may be deleted from active systems. Residual copies may remain temporarily in backups.

12. Security

APD maintains reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, destruction, alteration, loss, misuse, or disclosure. Safeguards may include access controls, authentication, encryption in transit, logging, monitoring, restricted administrative access, updates, backups, and operational security procedures. No Internet-connected system can guarantee absolute security.

13. U.S. State Privacy Rights

Depending on state of residence, applicable law, and processing context, individuals may have rights to confirm processing; access; correct; delete; obtain a portable copy; opt out of sale, certain targeted advertising, or qualifying profiling; limit certain uses of sensitive personal information; withdraw consent; appeal a privacy decision; and exercise rights without unlawful discrimination or retaliation.

These rights may be subject to legal exceptions, including completing transactions, providing the Service, security, fraud prevention, required records, and legal claims.

14. Texas Residents

Where the Texas Data Privacy and Security Act or another applicable Texas privacy law applies, eligible Texas residents may have rights to confirm processing, access, correct inaccuracies, request deletion, obtain certain personal data in portable format, and opt out of certain targeted advertising, sale of personal data, or qualifying profiling.

APD does not currently sell personal data or use personal data collected under this Policy for targeted advertising as described above.

15. Exercising Privacy Rights and Appeals

Privacy requests may be submitted to hola@tiksiflow.com, preferably with the subject Privacy Request. The request should provide enough information for APD to identify the requester, understand the request, locate relevant information, and verify identity when permitted or required.

Where applicable law provides an appeal right, an appeal may be submitted by replying to APD’s response or emailing the same address with the subject Privacy Appeal. APD will respond within the timeframe required by applicable law.

16. Authorized Agents and Non-Discrimination

Where applicable law allows an authorized agent to act on an individual’s behalf, APD may request documentation reasonably necessary to verify the agent’s authority. APD will not unlawfully discriminate or retaliate against a person for exercising a privacy right.

17. Children’s Privacy

TiksiFlow is intended for business and professional use and is not directed to children. APD does not knowingly solicit personal information directly from children under thirteen (13) through account registration. If APD learns that information was collected directly from a child in circumstances requiring parental consent and consent was not obtained, APD will take reasonable steps required by law.

18. Changes to This Privacy Policy

APD may update this Policy to reflect changes in law, TiksiFlow functionality, technology, security practices, service providers, or business practices. The current Policy will identify its most recent update date and version. Material changes will be communicated through email, TiksiFlow, the website, or another appropriate electronic method as required by law.

19. Language

APD may provide translations for convenience. For United States operations, the English version will be used to resolve an inconsistency between translations to the extent permitted by applicable law.
